1. What this Platform is (and is not)

DelivIndia provides a technology platform connecting Riders and Drivers for intra-state cargo delivery. DelivIndia is NOT a transport, courier, or logistics company. Drivers are independent service providers, not employees, agents, or representatives of DelivIndia. The contract for carriage of goods is directly between the Rider and Driver.

2. Who can use the App

You must be 18+, legally able to enter a binding agreement under Indian law, and use a phone number belonging to you. One account per person. You are responsible for your OTP and device security.

3. Service area

DelivIndia is available for use across India. However, individual deliveries (pickup and drop locations within a single booking) must currently be within the same Indian state. Inter-state deliveries are not yet supported but may be enabled in the future.

4. Rider responsibilities

Provide correct pick-up/drop details and an accurate goods description; never book illegal, dangerous, or banned items; be available for OTP/proof steps; treat Drivers respectfully; pay the confirmed fare and any applicable toll, helper, or waiting charges.

5. Driver requirements and independent-contractor status

Complete verification (licence, RC, insurance, Masked Aadhaar, and other requested documents); keep documents genuine and current; drive safely and lawfully; complete deliveries honestly. Drivers are independent contractors — not employees, agents, or partners of DelivIndia. No verification, training, rating, or monitoring creates an employment relationship. Drivers may accept or decline any trip freely and may use other platforms.

6. Bargaining, fares, commission, tolls, waiting/helper charges, and payouts

Bargaining: For immediate bookings, the Rider may post a blank fare offer. Nearby Drivers may submit counter-offers, and the Rider and a Driver negotiate to a final agreed fare within the discovery and negotiation window shown in the app (currently up to 2 minutes discovery and 5 minutes negotiation). Once a Driver's offer is accepted, that fare is final for the booking. For other bookings, the fare shown before confirmation applies.

Commission: DelivIndia charges an 8% commission on the base delivery fare (whether set by the standard fare calculation or agreed through bargaining) on each completed delivery. A new Driver's first 5 deliveries are commission-free. This rate may change with notice via the app or SMS.

Helper (labour) charge and its commission: If a Rider requests loading/unloading assistance (up to 5 helpers), a helper charge applies — ₹200 flat for deliveries up to 20 km, plus ₹5/km beyond that distance. DelivIndia charges a separate 3% commission on the helper charge amount, distinct from the 8% commission on the base fare.

Toll tax: If a toll applies during a delivery, the Driver enters it manually in the app along with a receipt. The verified amount is charged to the Rider, in addition to the fare, with no commission deducted on the toll amount.

Waiting charge: The first 2 minutes at pick-up or drop are free. After that, a per-minute waiting charge applies based on vehicle category, capped at a limit shown in the app.

Payouts: A Driver's payout equals the base fare (after the 8% commission) plus the helper charge (after the 3% commission) plus any toll reimbursement (no commission), calculated on the full agreed/confirmed amounts. Where a Rider pays part of the fare using promotional wallet credit under Section 10, that discount is absorbed by DelivIndia and never deducted from the Driver's payout.

7. Cancellation policy

After a Driver accepts a booking, cancellation by the Rider is charged as follows:

This fee is deducted from any refund due and, where insufficient, from the Rider's wallet balance. Cancellation by the Driver after accepting does not attract this fee, but repeated unjustified Driver cancellations may lead to account review.

8. Payments

Via Razorpay (UPI/cards/net banking), in-app wallet, or Cash on Delivery where offered. DelivIndia never stores full card numbers.

9. Scheduled and recurring bookings

The App may allow you to schedule a booking for a future date/time or set up a recurring delivery schedule.

A scheduled booking is confirmed only once a Driver accepts it. Fare and availability for a future occurrence are calculated close to the scheduled time and may differ from an on-demand booking.

For a recurring schedule, each occurrence is a separate booking. You may pause, modify, or cancel the entire schedule, or an individual upcoming occurrence, at any time before a Driver accepts that occurrence.

Cancelling or modifying an individual occurrence after Driver acceptance is subject to the Section 7 cancellation fee.

Cancelling an entire recurring schedule does not, by itself, attract a fee; only occurrences already accepted by a Driver are subject to Section 7.

DelivIndia does not guarantee the same Driver for every occurrence, or that a Driver will be found for every scheduled occurrence.

You are responsible for keeping pick-up/drop details, goods description, and payment method current for all upcoming occurrences.

10. Wallet, rewards, and referral programme

Promotional/Reward Credit (from referrals, milestones, or other promotions) is not real currency. It cannot be withdrawn as cash, transferred to a bank account, or converted to money under any circumstance, and can only be applied as a discount against a future fare. DelivIndia may change, cap, pause, or end any promotion at any time.

Driver Earnings (trip payouts) are separate from promotional credit, are settled to the Driver's registered bank account/UPI, and are never mixed with or reduced by promotional credit given to Riders.

Rewards are credited only once DelivIndia's systems confirm the qualifying action. Fraud, fake accounts, self-referral, or abuse voids the reward and may lead to suspension.

11. Goods, damage, and liability

Drivers should handle goods with reasonable care; Riders must declare fragile/high-value items. DelivIndia is not automatically liable for loss, damage, or delay of goods in transit, except where Indian law does not permit exclusion, or where loss is directly caused by DelivIndia's own proven gross negligence in operating the Platform. Disputes are first raised between Rider and Driver, then with support, with evidence.

12. Disclaimer of warranties

The Platform is provided "as is" and "as available." DelivIndia does not guarantee uninterrupted availability, exact fare/time estimates, or that a Driver will be found for every booking.

13. Limitation of liability

To the maximum extent Indian law permits, DelivIndia's aggregate liability for any booking is limited to the commission it earned on that booking. DelivIndia is not liable for indirect or consequential losses, including lost business or profit.

14. Indemnity

You agree to indemnify DelivIndia against claims arising from your breach of these Terms, violation of law, or (for Drivers) your driving conduct or vehicle condition.

15. Acceptable use

No harassment, illegal activity, hacking/scraping, fake bookings/GPS/documents, or manipulation of ratings, referrals, or payments.

16. Suspension and termination

DelivIndia may warn, suspend, or permanently deactivate accounts for fraud, unsafe conduct, forged documents, illegal goods, payment abuse, or serious breach of these Terms. Reasons will be shared where practicable; active fraud risk may require immediate action. Appeals can be made via support.

17. Intellectual property

The DelivIndia name, logo, app, and software belong to DelivIndia and/or its licensors. No rights are granted beyond normal use of the Platform.

18. Grievance redressal

19. Changes to these Terms

Material changes raise the consent version in-app; continued use after notice means acceptance.

20. Governing law and dispute resolution

Laws of India apply. Disputes will first be addressed through good-faith discussion, then arbitration under the Arbitration and Conciliation Act, 1996, seated in Bihar, before litigation. Courts at Muzaffarpur, Bihar have exclusive jurisdiction, subject to mandatory consumer-protection rights.

21. Severability and entire agreement

If any provision is held invalid, the remaining provisions continue in full force. These Terms, with the Privacy Policy, form the entire agreement.
